I am only a small business. Do I need to comply with the Privacy Act?

The answer, as you would expect from a law firm, is it depends.

 

If you are a small business with a turnover less than $3 million per year then you do not need to comply unless you fit into one of the following exceptions:

  • You are operating a ‘rent roll’ or database of residential tenancies.
  • You are a contractor to the Government.
  • You are a health service provider.
  • You trade in personal information as a business.
  • You are related to a larger business that needs to comply.
  • You are a reporting entity for the purposes of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

A small business that is otherwise exempt can choose to be covered by The Privacy Act if it wishes.
