Our Probate and Administration Services
We understand that it is a traumatic enough time after the loss of a loved one that you don’t need the stress of applying for a grant of probate or letters of administration on your own. We can tailor our services to your circumstances and needs.
We can apply for probate (where there is a will) or letters of administration (where there is no will). We offer flexible payment options for our services including payment from the estate on completion of the matter and fixed fees.
We can administer the estate after we get the grant of probate or letters of administration or we can leave that to you. It’s important to us that you only receive legal services that you actually need and that are fair value.
Our administration service includes all aspects of administration that may be required (or, we can just point you in the right direction and direct you through the process).
We can:
- Sell or transfer any house or land (real property) that may be required.
- Sell or transfer any shares of the deceased.
- Attend to the taxation affairs of the deceased and the estate in a collaborative manner with accountants.
- Distribute the estate.
- Represent the estate in any legal proceedings or dispute that may arise in relation to the will.
Superannuation in Estates
Superannuation is not generally able to be dealt with in a Will. It may be that after you loved one passes away that there is a dispute between dependents, or persons claiming interdependence upon the person who has passed away as to who should receive the superannuation of the deceased.
In our experience, particularly when dealing with tragic deaths of young people, the superannuation with its death benefit is larger than the estate of the deceased person. If there is some risk of a dispute as to who should receive the superannuation we can help you with that to ensure that what is right and fair is done.
